Whereas:
(a)The organiser and the seller of the tourist package, to whom the consumer is addressing, must be in possession of administrative authorisation to carry out their activities;
(b) The consumer has the right to receive a copy of the contract for the sale of a tourist package (pursuant to Article 85 of the Consumer Code), which is an essential document to access the Guarantee Fund referred to in Article 18 of these General Terms and Conditions.
The concept of tourist package (Article 84 of the Consumer Code) is as follows: tourist packages are all inclusive trips, holidays and circuits, resulting from the predetermined combination of at least two of the elements indicated below, sold or offered for sale at a flat rate, and lasting more than 24 hours or extending for a period of time including at least one night: (a) transport; (b) accommodation; (c) tourist services not ancillary to transport or accommodation (omitted, etc.) … that constitute a significant part of the tourist package.
The sale of tourist packages, whether they concern services to be provided in Italy or abroad, will be governed by Law No. 1084 of 27/12/1977 ratifying and executing the International Convention on Travel Contracts (CCV) signed in Brussels on 23/4/1970 as applicable, as well as by the Consumer Code.

The booking request must be drawn up on a specific contract form, if necessary electronic, completed in its entirety and signed by the Customer, who will receive a copy.
The acceptance of the reservation is considered completed, with the consequent conclusion of the contract, only when the organization sends the relative confirmation, also by means of an electronic system, to the customer at the selling travel agency. The information relating to the tourist package not contained in the contractual documents, brochures or other means of written communication, will be provided by Nartea in regular fulfillment of the obligations provided for by Article 87 paragraph 2 of the Italian Civil Code before the start of the trip.
The price of the tourist package is determined in the Contract, with reference to what is indicated in the catalogue or to the non-catalogue programme and to any topics in the same catalogues or out-of-catalogue programmes that have subsequently occurred. The price may be changed up to twenty days before departure only as a result of changes in: transport costs, including fuel; duties and taxes on certain types of tourist services such as taxes, landing, disembarkation or embarkation fees in ports and airports; exchange rates applied to the package in question.
For such changes, reference will be made to the exchange rate in force on the date of publication of the program as reported in the catalog or on the date reported in any updates. Fluctuations will affect the flat rate of the tourist package in the percentage expressly indicated in the technical sheet of the catalogue or non-catalogue programme.
Regardless of the payment of the deposit referred to in art. 6 – In addition to the full cost of the registration fee (never refundable), the penalty in the following amount:
10% up to 30 working days before departure; 30% from 30 to 15 days before departure; 50% from 15 to 8 days before departure; 80% from 7 to 4 days before departure; 100% in the previous 3 days.

(c)| Withdrawals of practices that involve reservations of means of transport by air, sea or rail, are subject, for the part concerning transport, to penalties from IATA or the individual carrier. In the case of pre-established groups, these sums will be agreed on a case-by-case basis at the time the contract is signed.
The Consumer may withdraw from the Contract, without paying penalty, in the following cases:

exceeding 10%.
In such cases, the Consumer is alternatively entitled:
If, after departure, Nartea Servizi srls is unable to provide for any reason (except for a matter of the Consumer’s own act) an essential part of the services contemplated in the contract, it must provide alternative solutions, without any additional price to be paid by the contractor and if the services provided are of a lower value than those provided,
reimburse it in an amount equal to this difference.
If no alternative solution is possible, or if the solution prepared by Nartea Servizi srls is refused by the Tourist for serious and justified reasons, Nartea Servizi Srls will provide, at no additional price, a means of transport equivalent to the original one provided for the return to the place of departure or to the other place that may have been agreed, compatibly with the availability of the vehicle and places and will reimburse him to the extent of the difference between the cost of the services provided and that of the services provided up to the time of early return.
The Consumer who renounces may be replaced by another person provided that:

The official classification of the hotel facilities is provided in the catalogue or in other information material only on the basis of the express and formal indications of the competent authorities of the place where the service is provided.
In the absence of official classifications recognized by the competent Public Authorities, Nartea Servizi Srls reserves the right to provide its own description of the accommodation facility in the catalog or in the brochure, such as to allow an evaluation and consequent acceptance of the same part by the consumer.
Nartea Servizi Srls is liable for damages caused to the Tourist due to the total or partial non-performance of the services contractually due, whether they are carried out by him personally or by third party service providers, unless he proves that the event was the result of the consumer’s actions (including initiatives taken independently by the latter during the execution of the tourist services) or by circumstances unrelated to the provision of the services. presentations provided for in the contract, by fortuitous circumstances, by force majeure, or by circumstances that the organizer itself could not, according to professional diligence, reasonably foresee or resolve.
In any case, compensation for personal injury may not exceed the limits set by the international conventions to which Italy and the European Union are parties.
Pursuant to and for the purposes of Article 46 paragraph 2 of the Tourism Code, Nartea Servizi Srls is required to provide the assistance measures to the Tourist imposed by the criterion of professional diligence exclusively with reference to the obligations incumbent on it by law or by Contract.
The Organiser and the seller are exempt from their respective responsibilities (art. 13-14 of the following general conditions) when the non-performance or incorrect performance of the contract is attributable to the consumer or has depended on the fact of an unforeseeable or unavoidable third party, or on a fortuitous event or force majeure.
Any failure in the execution of the contract must be contested by the Tourist without delay so that Nartea Servizi Srls, its local representative or the accompanying person promptly remedy it. The Consumer may also lodge a complaint by sending a registered letter, with acknowledgment of receipt, to Nartea Servizi Srls or to the seller, no later than ten working days from the date of return to the place of departure.
If not expressly included in the price, it is possible, and indeed advisable, to take out at the time of booking at the offices of the organizer or seller special insurance policies against expenses arising from the cancellation of the package, accidents and luggage. It will also be possible to conclude a service contract that covers repatriation costs in the event of accidents and illness.
A national guarantee fund has been set up at the Ministry of Productive Activities to allow, in the event of insolvency or bankruptcy of the seller or Nartea Servizi Srls, the reimbursement of the price paid and the repatriation of the Tourist in the case of trips abroad, as well as to provide immediate economic availability in the event of forced return of tourists from non-EU countries in the event of emergencies, attributable or not to the conduct of Nartea Servizi Srls. The management and operation of the fund shall be determined by decree of the Minister of Productive Activities, in agreement with the Minister of Economy and Finance.

The application of these clauses does not in any way determine the configuration of the relevant contracts
as a type of tourist package. The terminology of the above-mentioned clauses relating to the tourist package contract (Nartea Servizi Srls, Viaggio, etc.) must therefore be understood with reference to the corresponding figures of the contract for the sale of individual tourist services (seller, stay, etc.)
