These general terms and conditions (hereinafter also referred to as “General Conditions”) govern the offering of products by Tenuta Cavalier Pepe Società Agricola S.r.l., VAT No. 02595130648 (hereinafter also referred to as the “Company”), on www.tenutapepe.it (hereinafter also referred to as the “Site”). The General Conditions must be accepted by the user upon registration on the Site in order to access the offers and proceed with the purchase of products. The Company reserves the right to amend the General Conditions, in whole or in part, at any time, by notifying users on the Site at least 30 days in advance should the terms of product and service usage change. Users are therefore invited to periodically review this page to stay updated on the current conditions. Continued use of the Site following such changes constitutes tacit acceptance of the same.
The Site is owned by Tenuta Cavalier Pepe Società Agricola S.r.l., headquartered at Via Roma 42, 83040 Luogosano (AV), Italy, Tax Code and VAT No. 02595130648. The products available on the Site are sold directly by the Company. Products may be sold either through a permanent catalog or via “flash deals,” which are promotions subject to quantity and/or time limits. The offer includes food, alcoholic products, and accessories (such as wine, sparkling wine, rum, grappa, other spirits, coffee, packaged products like sauces, honey, canned meats, and accessories for food preparation, consumption, or storage). Upon completion of a purchase transaction, the Company will issue an order confirmation to the user.
The offers concern the purchase of goods at the prices listed on the Site. The Company reserves the right not to process orders from subjects other than “consumers,” in accordance with its commercial policy. In any case, the Company does not sell alcoholic beverages to individuals under 18 years of age. By placing an order, the consumer guarantees that both the ordering party and, if different, the recipient of the goods, are over 18 years old.
Prices are expressed in Euros and include VAT. Shipping costs may be fixed or variable, calculated based on weight, number of items, and destination address; or included in the price or free when exceeding certain thresholds of total order value or number of items. The user is always informed of the total shipping cost before completing the purchase. Images accompanying product descriptions are indicative and may differ from the actual product.
The validity of offers may be limited by quantity or time, and such limits are clearly indicated on the Site. The Company may modify the duration or quantity of offers but will honor orders placed during the validity period. In some cases, product availability may end after the purchase is completed: in such cases, the Company will refund the user. For some offers, a specific product variant may not be guaranteed; the user acknowledges that they may receive a different variant from the one initially chosen.
Each order sent constitutes an offer to purchase and is subject to the availability and discretionary acceptance of the Company. Once the conditions of the offer have been reviewed, the user may complete the order following the procedure indicated on the Site. Before finalizing the order, a summary will be shown, indicating the unit price, total cost, and any applicable shipping costs.
Shipping costs are calculated based on the weight, number of items, and destination, and may be fixed, variable, included, or free. Upon confirmation, the user must proceed with the payment in favor of Tenuta Cavalier Pepe Società Agricola S.r.l. The order will be processed only after full payment of the price, taxes, and shipping fees.
Accepted payment methods: credit cards (Visa, MasterCard, BancoPosta, PagoBancomat, American Express); PayPal; bank transfer. After completing the order, the user will receive an order summary email (which does not constitute acceptance) containing delivery and billing information. If a product becomes unavailable after purchase, the Company will provide a refund. For bank transfers, payment must be made within 10 days. If payment is not made within this time, the Company may cancel the order. Upon successful payment, the Company will ship the goods via courier.
If incorrect or incomplete information is provided, the user must promptly notify the Company by emailing ordini@tenutacavalierpepe.it. The user is responsible for any consequences arising from incorrect or incomplete address information.
Tenuta Cavalier Pepe Società Agricola S.r.l. does not process or store payment data, which are managed and encrypted by the payment service providers. The Company only receives the transaction outcome. Therefore, it is not responsible for any refusal of the payment method used.
The Company may issue discount codes (“Coupons”) for use during product purchases. Coupons may have a fixed or percentage value, are generally not cumulative unless otherwise specified, and may have an expiration date and minimum purchase requirements. Coupons may not be sold or transferred without authorization. Coupons issued for friend referrals may be revoked in case of improper use.
The Company ships exclusively within Italy, excluding San Marino, Vatican City, Livigno, and Campione d’Italia. For international shipments, please contact ordini@tenutacavalierpepe.it. Shipping within Italy takes place within 10 working days from payment confirmation. If a product is unavailable after the order is placed, a full refund will be issued. Users will receive a shipping confirmation email and may request tracking information.
It is important to provide a valid telephone number. Delivery is made at street level. Upon delivery, the user must check the packaging and immediately report any damage or anomalies in writing to the courier. Any issues with product integrity, correspondence, or completeness must be reported within 3 days.
The consumer has the right to withdraw from the contract without penalties within 14 working days from receipt of the product, pursuant to Article 52 of the Consumer Code. Withdrawal may be exercised using the standard form or by an explicit declaration sent by registered letter with return receipt or fax. Return shipping costs are borne by the user. The product must be returned intact, with original packaging and labels. Withdrawal is excluded for food products that have been consumed, customized products, or products that deteriorate rapidly.
Refunds will be processed within 14 days, using the same payment method unless otherwise agreed. The Company may withhold the refund until the returned product is received. Delivery costs for more expensive shipping options chosen by the user are not refundable.
The Company is not liable for damages resulting from the use of the Site, including viruses, service interruptions, or malfunctions caused by external events. It is only liable for defects or non-conformities in the products sold.
Personal data are processed in accordance with Regulation (EU) 679/2016 GDPR and Italian Legislative Decree no. 196/2003. For information about data processing, users can contact tenutacavalierepepe@legalmail.it. During registration, users may be asked to consent to receive marketing communications.
The Site uses cookies to enhance the browsing experience. Cookies collect non-sensitive statistical data. Cookies can be disabled via browser or device settings.
These General Conditions are governed by Italian law. In case of disputes concerning the interpretation, execution, or termination of the contract, the parties may attempt mediation pursuant to Article 49 of the Consumer Code. If mediation fails, jurisdiction is assigned to the user’s residence or domicile if the user is a consumer, or to the Court of Avellino if the user is a professional.
